Correct about VFR on top being legal in the US. Not sure in Europe and UK, It is not legal in Argentina. Not sure about "significant restrictions", or any restriction whatsoever on top of the normal VFR restrictions. FYI I looked it up and to fly "VFR on top" you need to be on a...

It seems the state of the art of DIY flying cars is "not quite there yet". Except for extremely short-range operations where the car is not expected to be reused.

I'd put the vast majority of the blame on ATC for this one. Yes the pilot did some things wrong, but humans in distress should not be expected to make the best decision 100% of the time... whereas ATC had a whole pile of opportunities to do the right thing and failed to do so.
