I rest my case.
The commander noticed that the aircraft was not decelerating as expected. He did not
associate this with the fault in the spoilers and assumed that the problem was due to a
fault in the brakes. He therefore applied the emergency brakes.

The flight crew got information that both lift spoiler systems had failed, and thought that in
addition the brake system had failed. For that reason they changed to emergency brakes

So it was pilot error.

So it was pilot error.
There were several pilot errors here:
- Misdiagnosed why the pane wasn't braking.
- Locked the brakes (the report doesn't say it directly, but it seems from the systems and procedures description that activating the emergency brake enables the brakes to be fed by a reserve electric hydraulic pump and by accumulators, but you still need to work the brakes through the pedals, so the pilot actively locked the brakes by pressing the pedals too much and keeping them down).
- Failed to release brakes pressure, which is the procedure to recover from any kind of hydroplaning.
- Failed to retract the flaps to increase WOW.

But it was not pilot error.
